MemoryDriver End User License Agreement (EULA)

Application Name: MemoryDriver
Provider: Evon Medics (“Evon Medics,” “we,” “our,” or “us”)
Apps made available through the Apple App Store are licensed, not sold, to you. Your use of the MemoryDriver application (the “Licensed Application”) is governed by this End User License Agreement (“Agreement”).
This Agreement is a legal contract between you (“User,” “you”) and Evon Medics, the Application Provider. Apple is not a party to this Agreement except as required under App Store terms.
Evon Medics reserves all rights in and to the Licensed Application not expressly granted to you under this Agreement.
A. Scope of License
Evon Medics grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download and use MemoryDriver on any Apple-branded device that you own or control, as permitted by Apple’s App Store Usage Rules.
This license allows you to use MemoryDriver only for personal, non-commercial purposes.
You may not:
Copy the Licensed Application except as permitted by Apple Usage Rules
Distribute or make the App available over a network for multiple devices simultaneously
Rent, lease, lend, sell, redistribute, or sublicense the App
Reverse engineer, disassemble, decompile, attempt to derive source code, modify, or create derivative works of any part of the App, except where such restriction is prohibited by law
Remove or alter proprietary notices or branding
Any updates, upgrades, or new versions provided by Evon Medics are also governed by this Agreement unless accompanied by a separate Custom EULA.
B. Consent to Use of Data
You agree that Evon Medics may collect and use technical and related information, including but not limited to:
Device information
Operating system version
App performance data
Crash logs and diagnostic information
Usage patterns within MemoryDriver
This data is collected to:
Improve app performance and reliability
Provide software updates and support
Enhance user experience
Develop evidence-based cognitive features
Evon Medics will use such information in accordance with the MemoryDriver Privacy Policy, and where possible, in a form that does not personally identify you.
C. Termination
This Agreement remains effective until terminated by you or Evon Medics.
Your rights under this Agreement will terminate automatically if you fail to comply with any term of this Agreement.
Upon termination, you must stop all use of the Licensed Application and delete all copies from your device(s).
D. External Services
MemoryDriver may enable access to third-party services, websites, or content (“External Services”).
You acknowledge and agree:
External Services are provided for convenience only
Evon Medics does not control or guarantee accuracy of third-party services
Use of External Services is at your sole risk
External Services may not be available in all regions or languages
You agree not to use External Services in a way that violates laws, infringes rights, or harms others.
Evon Medics may modify, suspend, or remove access to External Services at any time without liability.
E. Medical & Wellness Disclaimer
MemoryDriver is designed to support cognitive wellness and educational engagement.
MemoryDriver is not a medical device and does not provide medical advice, diagnosis, or treatment.
The App is not intended to replace consultation with qualified healthcare professionals.
If you experience serious memory problems or neurological symptoms, you should seek professional medical care.
F. NO WARRANTY
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK.
To the maximum extent permitted by law, MemoryDriver is provided “AS IS” and “AS AVAILABLE,” with all faults and without warranty of any kind.
Evon Medics disclaims all warranties, express or implied, including but not limited to:
Merchantability
Fitness for a particular purpose
Accuracy of results
Quiet enjoyment
Non-infringement
Evon Medics does not guarantee that the App will be uninterrupted, error-free, or fully secure.
Some jurisdictions do not allow certain warranty exclusions, so some limitations may not apply to you.
G. Limitation of Liability
To the extent not prohibited by law, Evon Medics shall not be liable for:
Personal injury
Loss of data
Loss of profits
Business interruption
Indirect, incidental, special, or consequential damages
Arising out of or related to your use of or inability to use MemoryDriver, regardless of the theory of liability.
In no event shall Evon Medics’ total liability exceed fifty dollars ($50.00) unless required otherwise by applicable law.
H. Export Restrictions
You may not use or export the Licensed Application except as authorized by United States law and the laws of the jurisdiction where the App was obtained.
You represent that you are not located in a country subject to U.S. embargo or listed on restricted party lists.
I. U.S. Government End Users
The Licensed Application and documentation are “Commercial Items” as defined in applicable U.S. regulations and are licensed to U.S. Government end users only with the same rights granted to other users under this Agreement.
J. Governing Law
Except as otherwise required by applicable law, this Agreement shall be governed by the laws of:
The State of California, United States, excluding conflict of law principles.
If you reside in the European Union, Switzerland, Norway, or Iceland, the governing law and courts shall be those of your usual place of residence.
The United Nations Convention on the International Sale of Goods does not apply.
